Force Majeure Notice – Public Bulletin - 20 November 2006

We refer to the declaration of Force Majeure (production) published on 16th February 2006.

The effects of the incident on 16 February 2006 have now been overcome to the extent that CSL is in a position to resume fulfilment of its obligations under the Storage Services Contract (SSC) in respect of production.  Accordingly CSL withdraws, with effect from 06:00 on 20 November 2006, its declaration of Force Majeure in respect of production and its election under clause 12.4 of the SSC that Clause 10.4 will apply to Production Allocations. 

For the avoidance of doubt, CSL also withdraws its election under clause 12.7 of the SSC that Clause 10.4 will apply to Production allocations.  As set out in the notice dated 16 February 2006, CSL's election under clause 12.7 was made without prejudice to the election under clause 10.4 and without prejudice to CSL's right to argue that the failure of production stream 3 constituted an event or circumstance of Force Majeure under clause 18 of the SSC.
